Terms of Service.
You automatically agree to these terms when purchasing any commissioned work or adoptables from me. By clicking the "Pay Now" button in an invoice, you create a digital signature that binds you to these terms. Please read this over carefully before making any purchases. If you need clarification, please email me at ghostly.grizzly@gmail.com, note me on deviantART, or private message me on Instagram. The following terms apply to past, present, and future commissioners.
Payment.
- All payment should be in USD ($) paid through PayPal. Points are accepted through deviantART when I am accepting them. If I am accepting points, I will make you a widget that you can pay through.
- All money payments will be made through invoices. I will invoice you. Do not send me any payments before receiving the invoice. Payments received through any other means, unless previously discussed, will be returned.
- Payment is due upfront, in full, unless the amount is over $100. Payment plans are available for over $100, please feel free to discuss payment plans. I will not begin your commission until I am paid in full or we discussed a payment plan. If you do not pay within three days the commission will be dropped and your slot given to another buyer.
- Once our negotiation is done and I start your commission, I cannot refund you the full amount. This is negotiable depending on the state of the commission. If not touched on refunds requested for longer than a month will only have a 75% return from the net received.
- Once the work is completed I cannot refund it. If you are unhappy with your commission, I can discuss any minor touch-ups or edits.
- It is the commissioner's duty to monitor their funds before commissioning me. Art is a luxury, please be sure you have the money to spare to commission me. I do not do refunds due to poor planning.
Artist.
By commissioning me, you’re purchasing my artist labor only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon. If you do not want your commission to be posted online as an example or shown at a convention booth as an example, please notify me when ordering.
- I will respect your request to not publicly post your commission. No explanation necessary.
- I cannot claim the Intellectual Property or reuse/resell the image for personal and commercial projects. Unless agreed upon.
- I reserve the right to reject your commission proposal without question. This includes if you did not follow the rules for said order or if I am uncomfortable with working for you after a background check (yes, I will investigate profiles and possibly ask other artists to see if are a good customer).
- I reserve the right to modify and resell any rejected sketches as "pre-posed" at a later date.
- I follow the Golden Rule, if you treat me with respect, I will treat you with respect in return. Good customers receive great service and little bonuses as a "Thank you!". If you do not treat me with respect, I will cancel your commission.
Commissioner.
You, the commissioner, may upload the work done for you to your site as long as it is credited and linked back to any of my galleries (either here, deviantART, or Instagram). Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to: icons, signatures, layouts, wallpapers, themes and personal site display.
If you are not sure whether your request counts as personal, feel free to ask me about its intended use BEFORE I start working on the commission, this way we're on the same page during the whole process.
- You retain the rights to the Intellectual Property.
- You may not claim the work to be your own, edit or set it up for redistribution. You may not use it for any external projects, commercial or non-commercial unless agreed upon.
- You may resell it with a character that is featured in the picture. The new owner will be bound by these terms of service as long as they are in possession of the piece. Reselling the image is only acceptable if it's not for reproduction such as prints, t-shirts, mugs, charms, etc.
- If you are looking for something to redistribute, reproduce, use for your project(s), as an ad, for a video, to resell at conventions etc. Speak to me for information on royalty fees.
- The commissioner must be 18 years or older to order on their own, or have a legal guardian's permission to order. There have been too many instances of kids buying art without permission and the adult having to file a chargeback.
If you are not sure whether your request counts as personal, feel free to ask me about its intended use BEFORE I start working on the commission, this way we're on the same page during the whole process.
Procedure.
You understand that I am not working with only your priorities in mind. They will take steps that are time consuming and slow. Please do not commission me if you are looking for fast and timely work.
- After payment is received: I sketch, color and paint depending on your commission type.
- I do not accept "description only" commissions. You must have at least one visual reference of the character. The more accurate the better, with flat colors rather than shading.
- Sketch commissions do not have an approval stage. You may request minor tweaks if I missed any distinguishing features present in your reference.
- For larger, full color commissions, one large edit is allowed during the sketch phase. I reserve the right to add a $10 USD fee over any edits after the first one.
- Please be clear and concise in your description of the change. You can use other works and photos you like as references for the changes! I accept "red-lining" or drawing over the image to show what you intend.
- I will always distribute a "color test" to fix any color errors of your character! Please, let me know if I have made any mistakes. Anything that needs to be fixed on my mistake, as it was on your reference(s) and I missed it, will always be fixed for free.
- A full size, no watermark image will be given. It is necessary that you use a watermark/resized version of the image before sharing publicly. I save transparent, individual files of the characters if asked for (automatically given if it's a custom character design).
Shipping.
In regards of the delivery of the final product:
- I ship through USPS, using bubble mailers or small envelopes (for teeny-badges or mini badges, mostly).
- For shipping, I require a full name and full address (building number, street name, state, ZIP code). If I'm given incomplete information I cannot guarantee the shipment will arrive on time--or at all.
- Within a few days of completion, the physical artwork will be sent, and after the art leaves the post office I am not responsible for mistakes made by the mailer (lost in mail, damages, etc.).
- For larger shipments that aren't letter-sized, I will provide a tracking number.
- Additional costs will be added for International shipments and bulky orders.
Restrictions.
